These Terms and Conditions (“Terms”) govern the use of the Zinc’s Home Improvement website and any services provided by Zinc’s Home Improvement (“Company,” “we,” “our,” or “us”). By using this website, requesting services, or accepting an estimate, you agree to these Terms.
1. Website Use
The content on this website is provided for general informational purposes only. Zinc’s Home Improvement reserves the right to modify, update, or remove website content at any time without notice.
Users may not copy, reproduce, distribute, or misuse any website content, logos, images, or branding without written permission.
2. Scope of Work
All work will be completed based on the written estimate, proposal, invoice, or agreement provided by Zinc’s Home Improvement. Any additional work requested outside the original scope may require a written change order and additional charges.
Verbal agreements or requests are not guaranteed unless confirmed in writing.
3. Estimates & Pricing
All estimates are valid for 30 days unless otherwise stated.
Material pricing, labor availability, and project conditions may change after the estimate is issued. If unforeseen conditions arise during the project, additional charges may apply.
Examples of unforeseen conditions include but are not limited to:

Hidden structural damage
-
Rot or water damage
-
Mold
-
Electrical or plumbing issues
-
Improper previous construction
-
Code violations
-
Unstable soil or ground conditions
The Client will be notified before additional work is performed whenever reasonably possible.
4. Deposits & Payments
A deposit may be required before scheduling or beginning work.
Payment terms will be outlined in the estimate or invoice. Unless otherwise stated:

Deposits are non-refundable once materials are ordered or work has begun.

Final payment is due immediately upon project completion.

Late payments may be subject to a 1.5% monthly finance charge or the maximum amount permitted by law.
The Company reserves the right to pause or stop work for nonpayment.
5. Change Orders
Any modifications to the original scope of work must be approved before the additional work is completed.
Change orders may affect:

Total project cost
-
Material selections
-
Completion timeline
-
Labor requirements
The Company is not responsible for delays caused by change requests.
6. Project Timeline
Estimated start dates and completion dates are approximate and may change due to:

Weather conditions
-
Material availability
-
Permit delays
-
Labor shortages
-
Client-requested changes
-
Site access limitations
-
Unforeseen project conditions
The Company is not liable for delays outside of its reasonable control.
7. Permits & Inspections
Unless otherwise stated in writing, the Client is responsible for obtaining permits, approvals, HOA authorization, surveys, and inspections.
If the Company agrees to obtain permits on behalf of the Client, permit fees and related costs will be added to the project total.
The Client is responsible for ensuring property lines are correctly identified before fencing, decks, sheds, or other structures are installed.
8. Access to Property
The Client agrees to provide reasonable access to the project area during scheduled working hours.
The Client is responsible for:

Removing valuables or fragile items from work areas
-
Securing pets
-
Providing access to utilities when needed
-
Ensuring the worksite is reasonably accessible
Additional charges may apply if the site is not ready or accessible.
9. Materials
Material selections, colors, finishes, and styles are subject to availability.
The Company reserves the right to substitute comparable materials if necessary due to supplier shortages or discontinued products.
Natural materials such as wood may vary in:

Color
-
Grain
-
Texture
-
Warping
-
Shrinkage
-
Cracking
These variations are normal and are not considered defects.
10. Warranty
Zinc’s Home Improvement provides a limited workmanship warranty of one (1) year from the date of substantial completion unless otherwise stated in writing.
This warranty covers defects caused directly by workmanship under normal residential use.
This warranty does not cover:

Normal wear and tear
-
Weather-related damage
-
Acts of God
-
Structural shifting
-
Water intrusion not caused by Company workmanship
-
Improper maintenance
-
Damage caused by third parties
-
Manufacturer defects
-
Customer-supplied materials
-
Existing conditions or pre-existing damage
Manufacturer warranties for materials are provided separately when applicable.
Warranty claims must be submitted in writing within the warranty period.
11. Limitation of Liability
The Company’s liability for any claim related to services performed shall not exceed the total amount paid by the Client for the specific project.
Under no circumstances shall the Company be liable for:

Indirect damages
-
Consequential damages
-
Lost profits
-
Loss of use
-
Incidental damages
12. Cancellation
The Client may cancel the project before work begins. However:

Deposits used for materials, scheduling, design work, or administrative costs may be retained.

Special-order materials are non-refundable.
-
Work completed prior to cancellation must be paid for.
The Company reserves the right to cancel or terminate a project due to unsafe conditions, nonpayment, harassment, or other material breaches of this Agreement.
13. Site Conditions & Safety
The Client acknowledges that construction and repair work involves noise, dust, debris, and temporary disruptions.
The Company is not responsible for:

Damage to hidden utilities or concealed conditions not disclosed before work begins
-
Minor lawn or landscaping disturbance caused by equipment access
-
Existing structural deficiencies
The Client agrees to keep children and pets away from active work areas.
14. Photography & Marketing
Unless otherwise requested in writing, the Company may photograph completed work for marketing, social media, website, or portfolio purposes.
No personal or sensitive customer information will be shared.
15. Governing Law
This Agreement shall be governed by and interpreted under the laws of the State of West Virginia.
Any disputes arising from services provided by Zinc’s Home Improvement shall be handled in the appropriate courts located within West Virginia.
16. Entire Agreement
These Terms and Conditions, together with any signed estimate, proposal, invoice, or written agreement, constitute the entire agreement between the Client and Zinc’s Home Improvement.
No verbal statements or prior discussions shall modify these terms unless confirmed in writing.
